Policy of reservation, cancellation and payment of the reservation.

Direct clients

With the purpose of offering the benefits and services published through the web site www.hotelescubanacan.com , satisfy the commercial relationship and process the requests made by you, our group will deal with your personal data in a confidential way, and only for the matters related to the reservation. When you fill in the questionnaire of ON-LINE Reserves you accept and authorize Cubanacan to use the personal data provided with the purpose of proceeding with the requested reservation.

Cubanacan requires the payment in advance and you should pay the total amount of the nights in the reservation. The charge to your credit card will be done 24 hours after you make the reservation. The charge will be in Euros and the receipt will read: Reserva de Cubanacan. The total amount includes all accommodation charges. Any extra charge as parking, telephonic calls or room service will be dealt directly with the facility.

Cubanacan guarantees that the information and files derived from the operation in the web site are his responsibility so they are duly declared and protected with the guarantee of total discretion and safety.

1.     Limitations in the use of the web site.

This web site is for your personal use and non-commercial according to the terms and conditions of this agreement, as a condition for its use, you will guarantee Cubanacan that you will not use this web site for illegal purposes, forbidden in the terms and conditions of this agreement. Specifically, you can not modify copy, transmit, show, authorize, create derived works or sell any product, service, information or software obtained in this web site.

2.     Guarantees 

You guarantee that you are 18 years or older, and that you have the legal authority to make this agreement and use the web site according to its terms and conditions. You agree to be financially responsible for the use of the web site and for the use of your name and credit card account to pay for products and services. You also guarantee that all the information you provide for the web site is reliable and accurate.

If you are an American citizen you are responsible for obtaining the pertinent travel documents required by the Government of the United States of America to make a trip to Cuba. Cubanacan is by no means responsible if you do not have all the pertinent documents before travelling to Cuba. Cubanacan is not responsible for any fine or lawsuit from the Department of Treasure of the United States as a result of your travel to Cuba.

3.     Formation of the contract

No contract will exist between you and CUBANACAN for the sale of any product unless and until, CUBANACAN accepts and confirms by email your reservation and issuing you a unique confirmation code.

4.     Access to third people´s web sites.

Our web site has access to web sites operated by different partners of Cubanacan. This access is offered to you only as a reference and for your convenience. Cubanacan does not possess or control the contents of these web sites so it is not responsible for the content or the use you make out of it.

5.     Electronic communications.

You are communicating electronically with us every time you visit the web site or send us emails. We will communicate with you through the notices in the site, email or fax. You agree that every notice, agreement and other information that we supply through the email or the fax obey the same legal requirements of the written communications.

6.     Clause of responsibility

The information, products and services published in the web site may present inaccuracies or typographical mistakes. The changes are added periodically to the already published information in the web site. Cubanacan may improve or change the web site at any given time. Cubanacan makes no representation about the convenience of the information, products or services contained for any purpose on the web site. All this information, products and services are presented just like that, with no guarantee at all.

7.     Applicable law.

When you visit Cubanacan hotels you are agreeing with the internal laws of Cuba. Cubanacan it is not responsible direct or indirect for any violation of these laws.

 8.     Modifications to this agreement

Cubanacan reserves the right to modify or change the terms and conditions of this agreement without previous notice and at any given time.

Any modification should be accompanied of the current date and a text related to the made modification.

9.     Reservation policy.

Cubanacan provides our products and services subject to the following conditions. Please read them carefully. If you visit us or make a reservation through the web site, you agree to these terms and conditions.

Booking confirmation-

Cubanacan will confirm on real time (On-Line) the request of every reservation, according to the availability on the system. The client should always pay in advance for the requested services; a charge of 10% is applied to the reservation, being the final price to pay.

This is the last condition before booking confirmation.

Cubanacan will send the client 2 mails simultaneously; the first will contain the information supplied by the client and the other a bill showing that the payment is already done. The client must show this bill at the reception of the hotel at the beginning of his/her stay.

The hotel and the call center will receive both mails.

Check in: the hotel reserves the right of admission before the established hour according to the availability. The check in is at 16:00 hrs. local time.

Check out: the hotel reserves the right of allowing a late check out after the established hour according to the availability. The check out is at 14 hours local time.

Once you have paid for the reservation, this will be the cancellation policy that applies.

Cancellation of the Reserve: the client can only cancel the reservation 72 hours before the check in at the hotel.

He/her will be reimbursed with the 85 % of the total amount of the money, because the remaining 15 % is to cover the administration expenses.

The cancellation request must be mailed to the following address:  callcenter@cubanacan.tur.cu, Cubanacan will send the client a notice concerning the reimbursement.

Modification of the Reserve: The client cannot modify his/her reservation, in order to do so, he has to cancel and then make a new reservation. If the reserve the client wants to modify is already paid, he will be reimbursed the total amount of the money with no cancellation charge.

No show policy: the hotels will allow you to check in 24 hours after or previous to the original date. After this period of time, the hotel will reserve the right to cancel the reservation.

If a Force Majeure situation (natural disasters, conflicts in the region, accidents) prevents you from arriving to the hotel within the 24 hours after your reserve date, you  must communicate with the hotel in some way. The total amount of the reservation money will be reimbursed to the client.

The no-show means losing the entire amount of the first night payment for more than 2 nights reservations and the 50% of the total amount of the remaining nights of the reserve. If the reservation is just for one night then you will be reimbursed with the 50 % of the payment.

The cost will be charged to your credit card 72 hours after receiving the reimbursement

demand with the requested information.

If the cancellation of the reserve is done 1 or 2 days before the client’s check in date, he/she will be charged the cost of one night.

Ease of booking: the hotel offers the possibility of establishing contact through the email: callcenter@cubanacan.tur.cu, given the case that there is no availability in the date you decided to make the reservation. In such cases you will be given an answer as soon as possible.

Reimbursement due to incompletion of service: in case of service incompletion you will be reimbursed 100% of the amount.

3. ¿Con qué finalidad tratamos tus datos personales?

Tratamos los datos que Usted nos facilita para los siguientes fines:

Acceder al Portal Web. Para facilitarle el acceso y el uso de nuestro portal, lo que incluye la gestión de los datos de registro y su cuenta.

Prestación de servicios. Para gestionar las solicitudes recibidas de compra de los servicios ofertados en nuestro portal, así como la gestión propia de servicios contratados, tales como: la confirmación, la modificación o la cancelación de reservas.

4. Tiempo de conservación de los datos personales

De manera general conservamos sus datos durante la vigencia de la relación que Usted mantiene con nosotros. Cancelaremos sus datos cuando hayan dejado de ser necesarios o pertinentes para las finalidades para las cuales fueron recopilados.

Si decide cerrar su cuenta en nuestro portal web, nosotros la desactivaremos y eliminaremos sus datos personales. Recuerde que una vez que Usted haya cerrado su cuenta, ya no podrá acceder al sitio, ni a su información personal; sin embargo, podrá abrir una cuenta nueva en cualquier momento.

6. Sus derechos y cómo Usted puede ejercerlos

Usted tiene los siguientes derechos en relación con sus datos:

Derecho a saber si estamos tratando sus datos personales y, en tal caso, a acceder a los mismos.

Derecho a rectificar y modificar sus datos cuando no sean correctos o sean inexactos y solicitar su supresión, cuando ya no sean necesarios para los fines para los que fueron recogidos.

En determinadas circunstancias, Usted tiene derecho a solicitar la limitación del tratamiento de sus datos, en cuyo caso únicamente los conservaremos para el ejercicio y defensa de reclamaciones, para aquello para lo que Usted nos de su consentimiento o para atender responsabilidades legales y contractuales.
